Castle Rock Insurance LLC

Effective Date: January 17th, 2026

These Terms of Service (“Terms”) govern access to and use of the Castle Rock Insurance Opportunity Portal (the “Portal”). The Portal is owned and operated by Castle Rock Insurance LLC, a Colorado limited liability company (“Castle Rock Insurance,” “CRI,” “we,” “us,” or “our”).

By creating an account, accessing the Portal, purchasing credits, or claiming any Prospect, you (“Agency,” “you,” or “your”) agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Portal.

1. Eligibility and Account Access

The Portal is intended solely for licensed insurance professionals and insurance agencies. By using the Portal, you represent and warrant that you and your Agency maintain all licenses, registrations, and authorizations required to solicit, quote, bind, and sell insurance in the jurisdictions where you operate.

Castle Rock Insurance LLC reserves the right, in its sole discretion, to approve, deny, suspend, restrict, or terminate Portal access at any time. Access may be limited or revoked if your account presents risk to consumers, the Portal, or Castle Rock Insurance LLC.

2. Definitions

Prospect means a consumer lead generated through Castle Rock Insurance marketing channels and made available through the Portal.

Claimed Prospect means a Prospect accessed after credits are redeemed.

Credits means prepaid access units required to claim Prospects.

Preview Information means limited Prospect data displayed prior to credit redemption.

Agency means your business entity and its authorized employees, contractors, or representatives who access the Portal under your account.

3. Source of Prospects

Prospects originate from Castle Rock Insurance marketing channels, including but not limited to web forms, call tracking systems, digital advertisements, and intake funnels. Castle Rock Insurance LLC does not guarantee the accuracy, completeness, timeliness, or ongoing availability of any Prospect information.

4. Permitted Use of Prospects

Prospects may be used solely for insurance quoting, placement, and related insurance services.

Prohibited uses include, but are not limited to, list building, unrelated marketing, resale or redistribution of data, data enrichment for non-insurance purposes, or any use outside the insurance quoting process.

5. Credit-Based System

The Portal operates on a credit-based system. Credits must be purchased before claiming any Prospect. Credits are the exclusive method for accessing Prospects.

Credits have no cash value and may not be exchanged for money. Credits may not be transferred, traded, or sold outside your Agency. All credit purchases are final, except where a credit return is approved under the Guaranteed Connection Credit Policy.

6. Exclusivity After Claiming a Prospect

Once credits are redeemed, the Prospect becomes exclusive to your Agency. Exclusivity remains in effect unless and until credits are returned pursuant to an approved credit return.

If credits are returned, exclusivity ends immediately, and Castle Rock Insurance LLC may reassign or resell the Prospect.

Claimed Prospects may not be shared, forwarded, sold, traded, or disclosed outside your Agency. Your Agency is responsible for ensuring internal compliance with this restriction.

7. Confidentiality and Data Security

Prospects contain sensitive consumer information. Your Agency must maintain reasonable administrative, technical, and physical safeguards to protect Prospect data.

You may not publish Prospect data, forward Prospect data outside your Agency, upload Prospect data to systems that violate federal or Colorado privacy laws, or store Prospect data in an insecure or non-compliant manner.

Any breach of confidentiality may result in immediate suspension or termination of Portal access and may subject your Agency to legal or regulatory action.

8. Accurate Representation to Prospects

When contacting a Prospect, you must identify your Agency name, disclose that you are an independent licensed insurance professional, and explain that Castle Rock Insurance connected you with the Prospect.

You may not represent yourself as Castle Rock Insurance, imply employment or partnership with Castle Rock Insurance LLC, or otherwise misrepresent your relationship with CRI.

9. Compliance Requirements

Your Agency is solely responsible for compliance with all applicable federal, state, and local laws governing outreach, quoting, binding, data handling, recordkeeping, and consumer communications.

This includes, without limitation, compliance with Colorado Division of Insurance regulations, the Colorado Consumer Protection Act, the Colorado Privacy Act, Colorado telemarketing and no-call laws, federal TCPA requirements, consent and opt-out obligations, and all applicable privacy and data protection laws.

Castle Rock Insurance LLC does not provide legal advice and does not supervise or control your outreach practices.

10. Colorado-Specific Notice and Indemnification

This Portal operates under Colorado law. By using the Portal, you acknowledge responsibility for compliance with Colorado producer regulations, privacy laws, and consumer protection rules.

Castle Rock Insurance LLC does not supervise or monitor your conduct. Nothing in these Terms replaces advice from legal counsel licensed in Colorado.

Your Agency agrees to defend, indemnify, and hold harmless Castle Rock Insurance LLC from all claims, investigations, fines, penalties, losses, damages, lawsuits, and regulatory actions arising from your conduct or violations of applicable law.

11. Fair Use of Prospect Previews

Preview Information is provided solely to assist your Agency in deciding whether to redeem credits. Preview Information may not be used for outreach or contact purposes.

You may not screenshot, save, copy, record, store, or otherwise use Preview Information except to evaluate a Prospect prior to purchase.

12. Guaranteed Connection Credit Policy

Castle Rock Insurance LLC recognizes that, in limited circumstances, a Claimed Prospect may be genuinely unreachable despite reasonable follow-up efforts. To protect agents while preserving prospect quality, Castle Rock Insurance LLC may approve a credit return under the conditions below.

Discounted prospects, aged prospects, and prospects purchased at reduced or promotional rates are expressly excluded from this policy and do not qualify for Guaranteed Connection credits.

12.1 Eligibility for Credit Return

A credit return request may be submitted only if all of the following conditions are met: At least seventy-two (72) hours have passed since the prospect purchase. A clear summary of reasonable contact attempts is provided. Contact attempts were made using the Prospect information supplied. The Prospect was genuinely unreachable and not merely delayed or unresponsive.

Requests must be submitted within five (5) business days following the seventy-two (72) hour period.

12.2 Review and Approval

All credit return requests are manually reviewed by Castle Rock Insurance LLC. Approval is not automatic and is granted at the sole discretion of Castle Rock Insurance LLC.

If approved, credits are returned to the Portal account for future use only. No cash refunds or payment reversals are issued. Prospect exclusivity ends immediately upon approval.

12.3 Limitations and Abuse

Credit returns apply only to verified failure to make contact. Credits are not issued for underwriting outcomes, pricing outcomes, lack of Prospect interest, or delayed responses.

Prospects showing evidence of contact, partial engagement, or delayed response do not qualify. Excessive or abusive requests may result in removal of credit privileges, suspension, or termination of Portal access.

13. Credit Purchase, Use, and Expiration Policy

Credits may be purchased in advance or at the point of prospect purchase through the Portal checkout, including purchasing credits during checkout (for example, purchasing fifty (50) credits for fifty dollars ($50)).

All credit purchases are final. Castle Rock Insurance LLC does not issue refunds or monetary reimbursements for unused credits. Credits have no cash value and may be used only within the Portal.

13.1 Credit Expiration

Purchased credits expire one (1) year from the date of purchase.

Promotional or bonus credits expire thirty (30) days from the date they are issued, unless otherwise stated in writing.

Expired credits are permanently forfeited and may not be reinstated, refunded, or extended.

13.2 Account Activity and Credit Forfeiture

Castle Rock Insurance LLC reserves the right to void unused credit balances if an Agency has been inactive in the Portal for twelve (12) consecutive months. Activity includes logging in, purchasing or redeeming credits, updating account information, or performing any action within the Portal.

13.3 Responsibility for Credit Management

Your Agency assumes full responsibility for monitoring credit balances and expiration dates. Failure to use credits within the applicable expiration period may result in permanent loss without compensation.

14. Purchasing Credits and Payments

Credit purchases are processed through WooCommerce or a designated payment processor. Your Agency must maintain a valid payment method, ensure sufficient funds, and resolve failed or declined payments promptly.

Castle Rock Insurance LLC may suspend Portal access if payments fail. All credit purchases are final except where a credit return applies under Section 12.

15. Prospect Feedback and Review Requests

Castle Rock Insurance LLC may independently contact Prospects to request feedback or online reviews regarding their experience. These communications are sent solely by Castle Rock Insurance LLC and do not involve your Agency.

Castle Rock Insurance LLC will wait at least ten (10) business days before sending any review request. Feedback requests are not intended to disrupt or interfere with your quoting process.

16. Prospect Information Accuracy and No Liability

Prospect information is collected through consumer self-reporting, automated intake systems, call recordings, web forms, and direct qualification through phone, email, or SMS communications.

While reasonable efforts are made to obtain accurate information, Castle Rock Insurance LLC does not guarantee accuracy, completeness, or reliability. All Prospect information must be independently verified before quoting, binding, or issuing coverage.

Changes in underwriting eligibility, pricing, coverage terms, or carrier decisions resulting from inaccurate or incomplete Prospect information do not qualify for refunds or credits beyond the Guaranteed Connection Credit Policy.

17. Prohibited Conduct

Castle Rock Insurance LLC may suspend or terminate Portal access if your Agency engages in misuse of Prospect data, breach of confidentiality, misrepresentation of your relationship with Castle Rock Insurance LLC, unlawful or deceptive outreach, non-insurance use of Prospect data, or attempts to bypass or manipulate the credit system.

Such conduct may also result in legal or regulatory action.

18. Warranty Disclaimer and Limitation of Liability

The Portal and Prospects are provided “as is” and “as available.” Castle Rock Insurance LLC disclaims all warranties to the maximum extent permitted by law.

Castle Rock Insurance LLC is not liable for lost profits, lost business, lost data, reputational harm, business interruption, or indirect or consequential damages. Your sole remedy for an unreachable Prospect is the credit return process described in these Terms.

19. Dispute Resolution and Arbitration

All disputes arising from or related to the Portal, Prospects, credits, or these Terms shall be resolved through binding arbitration in the State of Colorado. You waive the right to participate in class actions or class arbitration where permitted by law.

20. Updates to These Terms

Castle Rock Insurance LLC may update these Terms at any time. Continued use of the Portal after updates constitutes acceptance of the revised Terms.
